Honda Credit Cards
If you buy a motorcycle with a honda credit card is there a lein on it?
I want to buy a bike with an $8000 credit card and sell it to my son for $4500 as a partial gift, but want him to be liable and it be only in his name. I know normal financing involves a loan but how about with a honda card?
The simplest solution would be to make a cash gift of the $3500 you are willing to give. If, however, you do not have the $3500 and intend to carry this sum on a line of credit (your "honda credit card?"), then there are some necessary things to consider.
You will need a bill of sale to sell it to your son. Depending upon the state you live in, these requirements are different. Check with your Department of Transportation or Department of Motor Vehicles.
There will not be a lien against the bike because a lien is, essentially, a claim by a lender against the property if you fail to pay the funds billed. The lienor maintains a secured interest in the item until the lienee pays the balance or some other agreement is met and the lien is dismissed.
If you charge it to a line of credit, then you still owe the funds to the creditor but they don't have a specific "lien" or "encumbrance" against the item that your line of credit purchased. They can, if you fail to pay or live up to the contract, sue and have a lien placed against you or garnish your wages.
